Slip and fall on cruise ship results in $2.9 million verdict

In August 2009, plaintiff Denise Kaba was on a Carribean cruise on the Carnival Pride, when she slipped and fell on the pool deck while trying to move pool chairs. Her right knee was fractured in the fall.

Kaba had suffered a displacement and fracture of her right patella on her knee. She underwent open reduction and internal fixation, and she was subsequently placed in a knee mobilizer. Kaba is still under the care of treating doctors and undergoes physical therapy. She claims that she requires a brace from her hip to her knee to help her walk, and that she still remains in pain. She also argues that she is a candidate of eventual knee replacement surgery and may need to have her knee fused into place. Kaba's doctors state that she has reached her maximum recovery.

Kaba sued Carnival Corporation for premises liability alleging that the pool area had resin service creating a slippery floor. Kaba's premise liability lawyers argued that several other accidents had occurred in the past on the same type of surface on the Carnival Pride and other Carnival Corp. ships.

The defendant admitted liability.

Kaba also argued that she intended to return to work after her kids grew up, but the defendants argued against this since she had not worked for over 30 years.

Kaba was awarded $2.9 million in damages for medical costs, future loss in earning capacity, and for pain and suffering.
